第1條 為促使商品符合安全、衛生、環保及其他技術法規或標準,保護消費者權益,促進經濟正常發展,特制定本法。
Article 1 This Act is enacted to ensure compliance of commodities with the requirements set out in the safety, health, environmental protection, and other technical regulations or standards; to protect consumers' rights and interests; and to promote sound development of economic activities.
第2條 本法之主管機關為經濟部。
Article 2 The competent authority as referred to in this Act shall be the Ministry of Economic Affairs.
商品檢驗由經濟部設標準檢驗局辦理。
The Ministry of Economic Affairs shall set up the Bureau of Standards, Metrology and Inspection (hereinafter referred to as the BSMI) to take charge of the commodity inspection operations.
第3條 下列商品,經主管機關指定公告種類、品目或輸往地區者,應依本法執行檢驗:
Article 3 The following commodities shall be inspected in accordance with this Act as long as the categories, the items, and/or the shipping destinations of such commodities have been so designated and made known to the public by the competent authority per public notice:
第4條 檢驗工作除由標準檢驗局執行外,主管機關得將有關檢驗之技術工作,委託其他政府機關、法人或團體代為實施。
Article 4 Commodity inspection shall be conducted by the BSMI, and in addition thereto, any other government agency, juristic person or organization may also be commissioned by the competent authority to conduct technical activities related to such inspections.
主管機關得將相關檢驗合格證書之核(換)發及檢驗業務,委託其他政府機關、法人或團體辦理。
The competent authority may commission any other government agency, juristic person or organization to perform the operations in connection with the issuance of inspection certificates (new or replacement) and to conduct relevant inspection activities.
前二項受委託之其他政府機關、法人或團體應具備之資格、條件、評鑑、監督考核、相關檢驗合格證書之核(換)發、檢驗業務處理及相關管理事項之辦法,由主管機關定之。
Regulations governing the qualification requirements and prerequisites, assessments, supervision and performance evaluation of other government agencies, juristic persons or organizations so commissioned by the competent authority under the preceding two Paragraphs, and matters pertaining to the processing and administration of the issuance of inspection certificates (new or replacement) and commodities inspection operations shall be prescribed by the competent authority.
各種商品之檢驗方式,由主管機關指定公告之。
Inspection schemes applicable to different commodities shall be designated and made known to the public by the competent authority per public notice.
第6條 應施檢驗之商品,未符合檢驗規定者,不得運出廠場或輸出入。
Article 6 No commodity subject to inspection shall be released from the production premises, nor be exported or imported, if it does not conform to the inspection requirements.
前項商品採驗證登錄或符合性聲明方式執行檢驗者,主管機關得指定公告於進入市場前完成檢驗程序。
For commodities to be inspected via registration of product certification or declaration of conformity under the preceding Paragraph, the competent authority may designate and make it known to the public by public notice, that the inspection be completed before placing such commodities on the market.
第7條 應施輸入檢驗之商品,標準檢驗局依檢驗需要,得簽發輸入先行放行通知書,供通關之用,並得依規定派員前往貨物儲存地點予以封存。
Article 7 For commodities subject to import inspection, the BSMI may, as it is deemed necessary, issue a Notice for Prior Release of Imported Commodity for use in completing the customs clearance procedure, and may, in accordance with relevant provisions, dispatch its inspector(s) to the storage place of such cargo and to seal up such cargo pending inspection.
未符合檢驗規定前,不得運出貨物儲存地點。
No such cargo may be released from its storage place, unless it has passed the inspection.
受封存人無正當理由,不得對前項封存規避、妨礙或拒絕。
The person whose imported goods are sealed up shall not, without good cause shown, evade, hinder or refuse the seal-up operation set forth in the preceding Paragraph.
第一項先行放行之條件、先行放行通知書之核發、封存之要件及相關管理事項之辦法,由主管機關定之。
The competent authority shall prescribe regulations governing the conditions for prior release of imported goods, the issue of Notice for Prior Release of Imported Commodity, the requirements for performing the sealing-up operation, and the management matters associated therewith.
第8條 商品之報驗義務人如下:
Article 8 The following persons shall be obligated to file applications for commodities inspection (hereinafter referred to as the obligatory inspection applicant):
一採逐批檢驗及監視查驗者,為商品之生產者、輸出入者或代理商。
1.For commodities subject to batch-by-batch inspection and monitoring inspection: the manufacturer, exporter or importer, or the sales agent of the commodities involved;
生產者不在國內者,為其在國內有住所或營業所之代理商或輸入者。
the manufacturer;the sales agent or importer of the commodities involved having a domicile or business place in the Republic of China, in case the manufacturer is not based in the Republic of China;or
三商品之生產者、輸出入者或代理商不明或無法追查時,為銷售者。
3.Where the manufacturer, exporter or importer, or sales agent is unknown or cannot be located, the seller of thecommodities shall be the person obligated to file the application.
下列之人,視為生產者:
The following persons are deemed the manufacturers of commodities:
一商品係由個別零組件逕行組裝銷售,其組裝者。
1.For commodities which are assembled for sale directly from individual parts and components: the assemblers ofsuch commodities; or
二符合檢驗規定之商品於進入市場前,為銷售目的而修改,其修改者。
2.For commodities conforming to the inspection requirements and modified for the purpose of sale before being placed on the market: the persons who performed the modification of such commodities.
第9條 應施檢驗之商品,有下列情形之一者,得免檢驗:
Article 9 Under any of the following circumstances, the commodity subject to inspection may be exempted from inspection.
一輸入商品經有互惠免驗優待出品國政府,發給檢驗合格證書者。
1.Where the imported commodity is attached with an inspection certificate issued by the government of the countryof origin of the commodity which provides a reciprocal inspection exemption treatment to the commodities of the Republic of China;
二各國駐華使領館或享有外交豁免權之人員,為自用而輸出入者。
2.Where the commodity is exported from or imported to the Republic of China for personal use by any member ofa foreign embassy or consulate located in the Republic of China or by any person who is entitled to diplomatic immunity;
