本法未規定者,適用其他法律之規定。

第2條主管建築機關,在中央為內政部;在直轄市為直轄市政府;在縣(市)為縣(市)政府。
Article 2 The competent authorities of building are the Ministry of the Interior at the central administration level, the bureaus of public works at the municipal level, and the departments of public works or the departments of construction at the county (city) level; where a county or city has not established the department of public works or the department of construction, the competent authority of construction is the county (city) government.
在第三條規定之地區,如以特設之管理機關為主管建築機關者,應經內政部之核定。
In the applicable areas as prescribed in Article 3, an administrative department specially established may act as the competent authority of construction with the approval of the Ministry of the Interior.

This Code is also applicable to the public-owned buildings used for the public in areas other than listed above.
第一項第二款之適用範圍、申請建築之審查許可、施工管理及使用管理等事項之辦法,由中央主管建築機關定之。
Regulations on the applicable scope of Subparagraph 1 and 2, review and approval of application for construction, construction management, and usage management shall be prescribed by the central competent authority of construction.
第4條(建築物)本法所稱建築物,為定著於土地上或地面下具有頂蓋、樑柱或牆壁,供個人或公眾使用之構造物或雜項工作物。
Article 4 The “buildings” mentioned in this Code refers to the structures or miscellaneous works fixed on the ground or under the ground surface, having top covers, beams, columns, or walls, and used for individuals or the public.
第5條(公眾用建築物)本法所稱供公眾使用之建築物,為供公眾工作、營業、居住、遊覽、娛樂及其他供公眾使用之建築物。
Article 5 The “buildings used for the public” mentioned in this Code refers to the buildings used for the work, business, residence, visit, and amusement of the public as well as other buildings used for the public.
第6條(公有建築物)本法所稱公有建築物,為政府機關、公營事業機構、自治團體及具有紀念性之建築物。
Article 6 The “public-owned buildings” mentioned in this Code refers to the buildings of government departments, public-operated institutions and autonomous organizations as well as the monumental buildings.
第7條本法所稱雜項工作物,為營業爐、水塔、瞭望臺、招牌廣告、樹立廣告、散裝倉、廣播塔、煙囪、圍牆、機械遊樂設施、游泳池、地下儲藏庫、建築所需駁崁、挖填土石方等工程及建築物興建完成後增設之中央系統空氣調節設備、昇降設備、機械停車設備、防空避難設備、污物處理設施等。
Article 7 The “miscellaneous works” mentioned in this Code refers to the industrial boilers houses, water towers, billboards, erected advertisement, bulk warehouses, broadcasting towers, chimney stacks, bounding walls, mechanical amusement facilities, swimming pools, underground storage sheds, supports and shelves required for construction, excavation and backfill of earth materials and other works, as well as central air conditioning equipments, elevating equipments, mechanical parking facilities, air shelter facilities, and waste disposal facilities etc.
第8條(主要構造)本法所稱建築物之主要構造,為基礎、主要樑柱、承重牆壁、樓地板及屋頂之構造。
Article 8 The “main structure of buildings” mentioned in this Code refers to the structure of foundation, main beams and columns, bearing walls, floor slab, and roof structures.
第9條(建造)本法所稱建造,係指左列行為:

二增建:於原建築物增加其面積或高度者。

四修建建築物之基礎、樑柱、承重牆壁、樓地板、屋架或屋頂,其中任何一種有過半之修理或變更者。

Repair: repair or alteration by a half of any of the foundation, beams and columns, bearing walls, floor slabs, roof truss or roof structures.
第10條本法所稱建築物設備,為敷設於建築物之電力、電信、煤氣、給水、污水、排水、空氣調節、昇降、消防、消雷、防空避難、污物處理及保護民眾隱私權等設備。
Article 10 The “building equipments” mentioned in this Code refers to the electrical power, telecom, gas, water supply, sewage, drainage, air conditioning, elevating, fire fighting, lightning absorption, air sheltering, waste disposal, and privacy right protection equipments installed on the buildings.
第11條本法所稱建築基地,為供建築物本身所占之地面及其所應留設之法定空地。
Article 11 The “building base” mentioned in this Code refers to ground occupied by a building and the statutory vacant space preserved.
建築基地原為數宗者,於申請建築前應合併為一宗。
Where the building base is in several lots, application shall be submitted to apply for merging them into a whole one.
前項法定空地之留設,應包括建築物與其前後左右之道路或其他建築物間之距離,其寬度於建築管理規則中定之。
The above-mentioned statutory vacant space of a building shall include the spaces between the building and the surrounding roads or other buildings, and the width will be prescribed in the building regulations.
應留設之法定空地,非依規定不得分割、移轉,並不得重複使用;
The statutory vacant space may not be divided, transferred, or designated repeatedly unless otherwise prescribed.
其分割要件及申請核發程序等事項之辦法,由中央主管建築機關定之。
