第1條 為釐定條約及協定之處理程序,特訂定本準則。
Article 1??The Regulations are prescribed to govern the processing of treaties and agreements.
第2條 中央各機關或其授權之機構或團體與外國政府、國際組織或外國政府授權之機構簽訂條約或協定,依本準則之規定處理。
Article 2??The Regulations shall apply when competent authorities of the central government, their authorized institutions, or organizations sign treaties or agreements with foreign governments, international organizations or foreign institutions.
第3條 本準則所稱條約,係指左列國際書面協定:
Article 3 “Treaties” referred to in the Regulations are international written agreements when:
一具有條約或公約之名稱者。
(1). carry the designation of “treaty” or “convention”;
三內容直接涉及國家重要事項且具有法律上之效力者。
(3). the contents of which directly involve issues of national interest, and are legally binding; and
四內容直接涉及人民權利義務且具有法律上之效力者。
(4). the contents of which directly involve people's rights and obligations, and are legally binding.
本準則所稱協定,係指前項條約以外之國際書面協定,不論其名稱及方式為何。
“Agreements” referred to in the Regulations are international written agreements other than treaties mentioned in the preceding paragraph, whatever their particular designations or how they are formulated.
第4條 條約內容如涉及領土之變更,應依憲法第四條規定辦理。
Article 4 If a treaty involves changes to national territory, it shall be processed in accordance with Article 4 of the Constitution.
第5條 條約及協定由外交部主辦。
Article 5 The Ministry of Foreign Affairs is in charge of treaties and agreements.
條約或協定之內容具專門性、技術性,以主管機關簽訂為宜者,得經行政院同意,由其主辦。
If a treaty or an agreement is professional or technical in contents, and is best signed by the competent authorities, it shall be signed by the competent authorities with the approval of the Executive Yuan.
第6條 由外交部主辦之條約或協定,其內容涉及其他機關之業務者,外交部應就該案件隨時與有關機關聯繫,或請其派員參與。
Article 6 If a treaty or an agreement of which the Ministry of Foreign Affairs is in charge involves other authorities, the Ministry shall maintain continuous contact with those authorities or request them to send staff to participate.
其正式簽署時,外交部得派員在場並注意約本文字、格式及簽名是否正確合宜。
When signing the document, the Ministry may send staff to ensure that the wording, format and signature on the document are all proper.
第7條 主辦機關於條約草案內容獲致協議前,得先就談判之總方針及原則,與立法院相關委員會協商。
Article 7 The competent authorities shall consult with related committees of the Legislative Yuan on general guidelines and principles before reaching an agreement on the text of a treaty.
第8條 條約或協定草案內容獲致協議時,除事先獲行政院授權或時機緊迫者外,主辦機關應先報請行政院核可,始得簽訂。
Article 8 When an agreement on the text of a treaty is adopted, the treaty shall not be signed, unless in the case of an emergency or unless it has been approved by the Executive Yuan in advance.
第9條 條約案經簽署後,主辦機關應於三十日內報請行政院核轉立法院審議。
Article 9 After signing a treaty, the competent authorities shall report within 30 days to the Legislative Yuan, through the Executive Yuan, for deliberations.
但條約案未具有條約或公約名稱,且未定有批准條款,而有左列情形之一者,依第十條規定程序辦理。
If a treaty does not have the name of treaty or convention in its designation, and does not have a ratification clause, but has one of the following instances, it shall be processed in accordance with Article 10:
一經法律授權簽訂者。
(1).
The document is authorized by law,
二事先經立法院同意簽訂者。
(2).
The document has been approved by the Legislative Yuan in advance.
三內容與國內法律相同者。
(3).
The document's contents are identical to domestic laws.
第10條 協定應於簽署後三十日內報請行政院核備;
Article 10 Agreements shall be submitted to the Executive Yuan within 30 days for review.
除內容涉及國家機密或有外交顧慮者外,並應於生效後,送立法院查照。
Unless containing national secrets or requiring additional diplomatic considerations, they shall be submitted to the Legislative Yuan for reference after entering into force.
第12條 條約或協定之約本,應同時以中文及締約他方之官方文字作成,兩種文本同等作準。
Article 12 The original of treaties and agreements shall be in both Chinese and the official language of the other signatory.
Both versions are equally authentic.
必要時,可附加雙方同意之第三國文字作成之約本,並得約定於條約或協定之解釋發生歧異時,以第三種文本為準。
A third version of the text written in the language of a third country may be added when necessary.
The third version shall govern should divergences in interpretation arise.
專門性及技術性之條約或協定約本,締約各方得約定僅使用某一國際通用文字作成。
In regards to treaties or agreements that are professional or technical in contents, signatories may agree to adopt a commonly used foreign language only for the original copies.
