本法未規定者，適用其他有關法律規定。
Article 1 This Act is enacted for the purposes of regulating food demand and supply, stabilizing food prices, improving food quality and maintaining the gains of producers and consumers.
Matters not provided in this Act shall be governed by other applicable laws.
第2條 本法所稱主管機關為行政院農業委員會。
Article 2 For the purposes of this Act, the term "competent authority" shall denote the Council of Agriculture, Executive Yuan.
第3條 本法所稱糧食，係指稻米、小麥、麵粉與經主管機關公告管理之雜糧及米食製品。
Article 3 The term "food" shall include rice, wheat, flour，and some coarse grains as well as processed rice products promulgated by the competent authority.
第4條 本法用辭定義如下：
Article 4 The definitions of the following terms of this Act shall be denoted as below:
一稻米：指稻穀、糙米、白米、碎米及相關產品米。
1.
Rice: paddy, brown rice, milled rice, broken rice and other related rice products.
二公糧：指政府所有之糧食。
2.
Public stock: Food owned by the government.
三委託倉庫：指受主管機關委託承辦公糧經收、保管、加工、撥付業務之農會、合作社、合作農場或其他公民營機構經營之倉庫。
3.
Mandated warehouses: Farmers associations, co-operatives, co-op farms or other governmental or privateorganizations that are commissioned by the competent authorities to handle the collecting, storing, milling and distribution of public stock.
五糧食業務：指經營糧食買賣、經紀、倉儲、加工、輸出及輸入等業務。

Food business: Business involved in the purchase and sale, brokerage, warehousing, processing, importation andexportation of food.
第5條 主管機關為策劃糧食產銷，每年應訂定計畫，以穩定糧食供需。
Article 5 The competent authority shall devise plans of food production and marketing every year in order to stabilize the supply and demand of food.
第6條 主管機關應辦理主要糧食生產、消費、成本與價格之調查、統計，並建立農戶耕地資料，作為策劃糧食產銷及管理之依據。
Article 6 The competent authority, for the purpose of food management, shall be responsible for making surveys and statistics of the production, consumption, production cost and market prices of major foods as well as establishing the data of farm families and cultivated lands.
前項農戶耕地資料，應包括農戶之戶籍、耕地之地籍、實際耕作人及耕作紀錄；
The above data of farm families and cultivated lands shall include the household registration records of family, the land registration records of cultivated land, the actual cultivators and cultivation records;
其建檔所需戶籍、地籍、稅籍資料，得洽請戶政、地政及稅捐稽徵機關提供；
the household registration records, land registration records, tax registration records necessary for filing purposes can be required of the household, land and tax offices to provide;
實際耕作人、耕作紀錄資料，由農戶申報之。
the families shall file the information regarding the actual cultivator and cultivation record.
第7條 糧食應准許自由輸出入。但為確保國家糧食安全，得予限制；
Article 7 Food shall be permitted for free import/export but to ensure the food of the nation, it may be subject to restrictions.
其限制項目，由主管機關公告之。
The restriction items shall be promulgated by the competent authorities of the government.
前項公告限制輸出、輸入之糧食，其輸出、輸入前，應徵得主管機關之同意。
For food subject to import/export restrictions, approval from the competent authorities of the government shall be obtained before the import/export.
稻米及米食製品之輸入，在海關進口稅則所定配額數量內，得由主管機關輸入，或依主管機關訂定之一定比例，由具有糧商資格之出進口廠商輸入。
For rice and rice product as promulgated by the competent authorities subject to import restriction under said Paragraph I, the importation shall meet the following requirements of WTO:
前項配額以外數量之輸入，由具有糧商資格之出進口廠商依關稅法相關規定輸入。
I.To be imported by the competent authorities of the government and may be sold by mark-up.
未具糧商資格者，得經主管機關專案同意，依關稅法相關規定輸入。
II.To be imported by the importers/exporters accredited for food trade after they properly apply to the competentauthorities of the government for import quota, the competent authorities of the government may collect mark-up.
經主管機關專案核准輸入原料糯(碎)米再加工製品輸出者，其輸入適用配額內稅率，數量不計入關稅配額；
III.Pursuant to the preceding paragraph, to be imported by the importers not accredited with the aforementionedqualifications, it is subject to approval from the competent authorities of the government.
The competent authorities of the government may collect mark-up.
輸入之資格、方式、程序、保證金及其他相關事項之管理辦法，由主管機關定之。
IV.In any other methods complying with the WTO requirements.The rate of the aforementioned mark-up shall not exceed the maximum level committed to WTO.
為因應國內糧食供需失調或有失調之虞或其他必要情形，經主管機關專案核准輸入者，其輸入適用配額內稅率，數量不計入關稅配額。
The quota allocation, procedures, objects, quota validity, mark-up, period of payment and other matters regarding quota administration under Paragraph III shall be determined by the competent authorities of the government.
第8條 公糧經收、保管、加工及撥付，得由委託倉庫辦理。
Article 8 The public stock may be collected, stored, milled and distributed by the mandated warehouses.
第9條 經收公糧稻穀，驗收項目為夾雜物、水分、容重量及品質；
Article 9 During collecting of public stock, the inspection of paddies shall include foreign matter, moisture content, test weight and quality.
