第1條 (訂定依據)本細則依區域計畫法(以下簡稱本法)第二十三條規定訂定之。
Article 1 These Rules are enacted pursuant to Article 23 of the Regional Plan Act (hereinafter referred to as “the Act”).
第2條 本法第四條第一項所定內政部、直轄市、縣(市)政府之所屬單位,在實施本法時,其主辦業務劃分如下:
Article 2 Upon implementing the Act, the sponsoring responsibilities of the departments subordinate to the Ministry of the Interior, or municipal or county (city) governments are divided as follows:
一在內政部,區域計畫之規劃、擬定、變更、核定、公告及區域計畫公告實施後區域之開發或建設事業計畫之督導、協調、推動,由營建署主辦;
At the Ministry of the Interior, the planning, preparation, alteration, approval, and announcement of regional plans as well as the supervision, coordination, and promotion of regional development or construction undertaking plans after a regional plan is implemented shall be sponsored by the Construction and Planning Agency; and
各種使用地編定與使用管制,由地政司主辦。
the classification of the lands of various purposes and utilization control shall be sponsored by the Department of Land Administration.
二在直轄市或縣(市)政府,區域計畫之開發或建設事業計畫之督導、協調、推動,由工務、建設或城鄉發展單位主辦;
At a municipal or county (city) government, the supervision, coordination, and promotion of regional development or construction undertaking plans shall be sponsored by the units of economic development, construction, or urban and rural development;
非都市土地使用分區、使用地編定與使用管制,由地政單位主辦。
the zoning, classification and utilization control of non-urban lands shall be sponsored by the unit of land administration.
第3條 依本法規定辦理區域計畫之擬定或變更,主管機關於必要時得委託有關機關、學術團體或其他專業機構研究規劃之。
Article 3 To prepare or alter regional plans pursuant to the Act, the competent authorities may entrust with related departments, academic organizations or other professional institutions to perform research and planning where necessary.
第4條 (擬定區域計畫應注意事項及計畫年期)各級主管機關依本法擬定區域計畫時,得要求有關政府機關或民間團體提供資料,必要時得徵詢事業單位之意見,其計畫年期以不超過二十五年為原則。
Article 4 To prepare regional plans pursuant to the Act, the competent authorities of all levels may require the related government departments or civil organizations to provide information, and may consult the opinions of authority where necessary.
In principle, the term of a regional plan shall be not longer than 25 years.
第5條 (劃定區域範圍應考慮因素)區域計畫之區域範圍,應就行政區劃、自然環境、自然資源、人口分布、都市體系、產業結構與分布及其他必要條件劃定之。
Article 5 The scope of a regional plan shall be allocated according to the boundary division, natural environment, population distribution, urban system, and industrial structure and distribution as well as other necessary conditions.
第6條 本法第七條第九款所定之土地分區使用計畫及土地分區管制,應以文字表明計畫目標及有關水土保持、自然生態保育、景觀、環境及優良農地保護、洪水平原管制以及天然災害防止等事項。
Article 6 The land-use plan and zoning control referred to in Subparagraph 9, Article 7 of the Act shall use texts to describe the objectives of the plan as well as the matters such as water and soil conservation, conservation of natural ecology, protection of landscape, environment and good farmlands, control of flood plains, prevention of natural disasters, and so on.
其為非都市土地之分區使用計畫,並應以圖面表明之,以為製定非都市土地使用分區圖之準據。
Where the plan is a segmented utilization plan of non-urban lands, it shall be illustrated as reference for plotting the non-urban land utilization segmentation map.
第7條 (審議區域計畫應徵詢之機關)各級區域計畫委員會審議區域計畫時,得徵詢有關政府機關、事業單位、民間團體或該區域建設推行委員會之意見。
Article 7 Upon examining regional plans, the committee of regional plans of all levels may consult with the related government departments, public institutions, civil organizations or the Regional construction committee about the opinions.
第8條 (索閱區域計畫書等)區域計畫公告實施後,人民得向主管機關繳納工本費,索取該區域計畫書及有關圖說。
Article 8 After a regional plan is announced and implemented, the people may pay the basic price to the competent authorities to ask for the prospectus of the regional plan and the related illustrations.
前項工本費之收支,應依預算程序辦理。
The incomes and expenditures of the above-mentioned basic price shall be handled according to the budget procedure.
第9條 (都市計畫等應與區域計畫配合)區域計畫公告實施後,區域內之都市計畫及有關開發或建設事業計畫之內容與建設時序,應與區域計畫密切配合。
Article 9 After a regional plan is announced and implemented, the contents and construction time sequence of the urban plans and the relevant development or construction undertaking plans within the region shall closely match with the regional plan.
原已發布實施之都市計畫不能配合者,該都市計畫應即通盤檢討變更。
Where an urban plan originally promulgated and enforced can't match with the regional plan, the urban plan shall be thoroughly reviewed and altered.
區域內各開發或建設事業計畫,在區域計畫公告實施前已執行而與區域計畫不符者,主管機關應通知執行機關就尚未完成部分限期修正。
Where a development or construction undertaking plan within the region that has already been promulgated and enforced before the regional plan is enforced doesn't meet the regional plan, the competent authority shall notify the executive department to make modification over the unfinished part within a specified time limit.
第10條 主管機關因擬定或變更區域計畫,依本法第十四條規定派員進入公私有土地實施調查或勘測時,應依下列規定辦理:
Article 10 Where the competent authority sends personnel to access public or private-owned lands to carry out investigation or reconnaissance survey according to Article 14 for the purpose of preparing or altering a regional plan, the following provisions shall govern:
一進入設有圍障之土地,應於十日前通知該土地所有權人或使用人。
To access a piece of land surrounded by bounding barriers, prior notice shall be given to the ownership holder or user of the land.
二必須遷移或拆除地上障礙物者,應於十日前將其名稱、地點及拆除或變更日期,通知所有權人或使用人,並定期協議補償金額。
Where the overground obstacles must be removed or dismantled, a notice shall be given to the ownership holder or user 10 days before, to notify him/her about the name, address, and date of dismantling or alteration, and determine the time of negotiation on the currency amount of compensation.
前項通知無法送達時,得寄存於當地村里長處,並於本機關公告處公告之。
Where the above-mentioned notice can't be sent to the ownership holder or user, it may be delivered to the chief of the local village, and shall be announced in the bulletin board of the department.
第11條 依本法第十四條第二項及第十七應發給所有權人或使用人之補償金,有下列情形之一時,應依法提存:
Article 11 In any of the following occasions, the compensation that should be given to the proprietary or user pursuant to Paragraph 2, Article 14 and Article 17 of the Act shall be deposited according to the law:
一應受補償人拒絕受領或不能受領者。
The person to whom compensation should be offered refuses to accept or can't accept the compensation.
二應受補償人所在不明者。
The whereabouts of the person to whom compensation should be offered is unknown.
