第3條 (水利事業之定義)本法所稱水利事業,謂用人為方法控馭,或利用地面水或地下水,以防洪、禦潮、灌溉、排水、洗鹹、保土、蓄水、放淤、給水、築港、便利水運及發展水力。
Article 3 The term “water resources” as referred herein shall mean utilization of artificial means or control of surface or ground waters for the purposes of flood control, tide water defense, irrigation, drainage, leaching of injurious salt, soil conservation, water reservation, silt dredge, water supply, pier construction, navigation, and water power development.
第4條 本法所稱主管機關:在中央為經濟部;在直轄市為直轄市政府;在縣(市)為縣(市)政府。
Article 4 The term “authority-in-charge” as referred herein shall mean the Ministry of Economic Affairs at the central level and local governments at the levels of province equivalent cities, hsien(county), and municipalities.
第5條 (水利區之劃分公告)中央主管機關按全國水道之天然形勢,劃分水利區,報請行政院核定公告之。
Article 5 The central authority-in-charge shall create water districts according to the country's watershed and submit the water district map to the Executive Yuan for approval and publication.
第6條 (中央水利機關)水利區涉及二省(市)以上或關係重大地方難以興辦者,其水利事業,得由中央主管機關設置水利機關辦理之。
Article 6 Where a water district that extends over two or more provinces (province equivalent cities) or is of great interests to localities may present hardship in administration, the central authority-in-charge may establish a control agency to do the administering.
第7條 水利區涉及二縣(市)以上或關係重大縣(市)難以興辦者,其水利事業,得由中央主管機關設置水利機關辦理之。
Article 7 Where a water district that extends over two or more hsien (municipalities) or is of great interests to hsien (municipalities) may present hardship in administration, the central authority-in-charge may establish a control agency to do the administering.
第8條 直轄市或縣(市)政府辦理水利事業,其利害涉及二直轄市、縣(市)以上者,應經中央主管機關核准。
Article 8 Any water resources project undertaken by the province equivalent cities or hsien (municipalities) and having impacts on two or more province equivalent cities or hsien (municipalities) shall be approved by the central authority-in-charge.
第8-1條 (應經核准之水利事業(二))引用一水系之水,移注另一水系,以發展該另一水系之水利事業,適用前條之規定。
Article 8- 1 Water from one water course may be drawn into another for the purpose of resource control for another, provided that approval first obtained from the central authority-in-charge.
第9條 (應經核准之水利事業(三))變更水道或開鑿運河,應經中央主管機關核准。
Article 9 Change of water courses or digging of waterscape is subject to the approval of the central authority-in-charge.
第11條 各級主管機關為辦理水利工程,得向受益人徵工;其辦法應報經上級主管機關核准,並報中央主管機關。
Article 11 For undertaking any hydraulic engineering construction, the authority-in-charge of each level may recruit workmen from those who benefit from the construction, provided that a recruiting proposal has been submitted to its superior authority-in-charge for approval and to the central authority-in-charge for filing.
第12條 (農田水利會之核准設立)主管機關得視地方區域之需要,核准設立農田水利會,秉承政府推行農田灌溉事業。
Article 12 The authority-in-charge may, taking into account the local needs, grant approval for organizing a farm irrigation association to undertake and develop farm irrigation work along with the policy laid down by the government.
前項農田水利會為公法人,其組織通則另定之。
The farm irrigation association referred in the preceding Paragraph shall be a public juristic person.
The rules of its organization shall be promulgated separately.
第13條 (水利協會之核准設立)政府興辦水利事業,受益人直接負擔經費者,得申請主管機關核准設立水利協進會。
Article 13 When the government undertakes water resources projects, those who benefit from the work and pay for its costs and expenses may apply to the authority-in-charge to organize a water resources promotion association.
第14條 (水利公司之核准設立)人民興辦水利事業,經主管機關核准後,得依法組織水利公司。
Article 14 Persons who take initiative to undertake water resources projects may organize a water resources corporation with the approval from the authority-in-charge.
第15條 (水權之定義)本法所稱水權,謂依法對於地面水或地下水,取得使用或收益之權。
Article 15 The term “water rights” as referred herein shall mean the rights to draw, use, or receive interests from surface or ground waters.
第16條 (非本國人取得水權之限制)非中華民國國籍人民用水,除依本法第四十二條之規定外,不得取得水權。
Article 16 Unless provided under Article 42 hereof, non-citizen of the Republic of China may acquire any water rights for the use of water; provided, however, the central authority-in-charge may apply for special approval from the Executive Yuan.

第17條 (取得水權後用水量之限制)團體公司或人民,因每一標的,取得水權,其用水量應以其事業所必需者為限。

前項順序,主管機關對於某一水道,或政府劃定之工業區,得酌量實際情形,報請中央主管機關核准變更之。
The authority-in-charge may change the priority listed above in connection with a particular water course or an industrial zone designated by the government according to the actual circumstances after obtaining an approval from the central authority-in- charge.
第18-1條 (用水標的之順序(二))多目標水庫用水標的之順序,依主管機關核准之計畫定之。
Article 18- 1 The priority of water usage of multiple-goal reservoirs shall be set by the authority-in-charge according its approved plan, unless the right owners of a particular body of waters have agreed otherwise, provided that such an agreement has been submitted to and approved by the authority-in-charge.
但各標的權利人另有協議,並報經主管機關核定者,從其協議。
Article 18- 1 The priority of water usage of multiple-goal reservoirs shall be set by the authority-in-charge according its approved plan, unless the right owners of a particular body of waters have agreed otherwise, provided that such an agreement has been submitted to and approved by the authority-in-charge.
第19條 (水權之停止、撤銷與限制)水源之水量不敷公共給水,並無法另得水源時,主管機關得停止或撤銷前條第一項第一款以外之水權,或加使用上之限制。
Article 19 Under the circumstances that public use is under supply and new water sources are unavailable, the authority-in-charge may suspend or revoke the water rights granted except under Clause 1 of Paragraph one of the preceding Article, or impose restrictions on usage.
前項水權之停止、撤銷或限制,致使原用水人受有重大損害時,由主管機關按損害情形核定補償,責由公共給水機構負擔之。
In the event that the suspension, revocation, or restriction of water rights under preceding Clause causes material damages to the user of the waters, the authority-in-charge shall measure and approve remedies for such damages and imposes the liabilities upon public water suppliers.
第20條 登記之水權,因水源之水量不足,發生爭執時,用水標的順序在先者有優先權;
