第1條 (船舶之定義及類別)本法所稱船舶，謂在水面或水中供航行之船舶，其類別如左：
Article 1 When used in the present Law, the term "Ship" means the vessel for navigating on the surface of water or under waters;including:
二非客船：謂不屬於客船之其他船舶。
2. "Non-passenger ship", which is any ship other than the passenger ship.
五非動力船舶：謂不屬於動力船舶之任何船舶。
5. "Non-power-driven ship", which is any ship other than the power-driven ship.
第2條 本法所稱中華民國船舶，謂依中華民國法律，經航政主管機關核准，註冊登記之船舶。
Article 2 The term "ROC (The Republic of China)-flag ship" used herein means a ship which is approved by and registered in the shipping administration authority pursuant to ROC laws.
一中華民國政府所有者。

The ship is owned by ROC government,
二中華民國國民所有者。

The ship is owned by ROC nationals, or
三依中華民國法律設立，在中華民國有本公司之左列各公司所有者：

The ship is owned by any of the following companies, which are organized under ROC laws, with principal offices situated within ROC territory:
(二)有限公司，資本三分之二以上為中華民國國民所有，其代表公司之董事為中華民國國民者。
(2) A limited company, of which at least two-thirds capitals are owned by ROC nationals and the director authorized to represent such company is a ROC national.
但其船舶為行駛國際航線者，其中華民國國民所有資本為二分之一以上。
However, the ROC national owned capitals shall exceed half of total capitals if the ships of such company are engaged in international voyages.
(四)股份有限公司，其董事長及董事三分之二以上為中華民國國民，並其資本三分之二以上為中華民國國民所有者。
(4) A company limited by shares, of which the chairman of the board and at least two-thirds directors are ROC nationals and at least two-thirds capitals are owned by ROC nationals.
但其船舶為行駛國際航線者，其中華民國國民所有資本及中華民國國民擔任董事之人數為二分之一以上。
However, in case the ships of such company are engaged in international voyages, its capitals owned by ROC nationals shall exceed half of total capitals, and the number of directors of ROC nationals shall exceed half of the total number of directors.
四依中華民國法律設立，在中華民國有主事務所之法人團體所有，其社員三分之二以上及負責人為中華民國國民者。

A juridical corporate, which is organized under ROC laws, with main office situated within ROC territory and at least two- thirds members and the statutory representative being ROC nationals.
第3條 (懸用中華民國國旗)非中華民國船舶不得懸用中華民國國旗。但法令另有規定或遇有左列各款情事之一時，得懸掛中華民國國旗：
Article 3 Any non-ROC flag ship shall not fly a national flag of the ROC, except otherwise stipulated in laws or under any one of the following circumstances:
一中華民國國慶日或紀念日。

On the National Day or any memorial day; of the R.O.C., or
一停泊外國港口遇該國國慶或紀念日時。

On the National Day or any memorial day of a foreign country of which a port the ROC-flag ship is calling; or
第5條 (非中華民國船舶停泊港灣口岸)非中華民國船舶，除經中華民國政府特許或為避難者外，不得在中華民國政府公布為國際商港以外之其他港灣口岸停泊。
Article 5 Unless otherwise specially approved by the ROC government or for seeking shelter, any non-ROC flag ship shall not stay in any harbor or port other than those announced by the ROC government as international port.
第7條 (中華民國船舶航行之要件)中華民國船舶，非領有中華民國船舶國籍證書或中華民國臨時船舶國籍證書，不得航行。
Article 7 Any ROC-flag ship, unless obtaining a Certificate of Vessel′s Nationality (Register) or a Provisional Certificate of Vessel′s Nationality (Register) of the R.O.C., shall not navigate except for one of the following circumstances:
但遇有左列各款情事之一時，不在此限。

一下水或試航時。

When the ship is launched or under sea trial;
二經航政主管機關許可或指定移動時。

When the ship is permitted or ordered to shift by a shipping administration authority; or
第8條 (船舶應備之標誌)船舶應具備左列各款標誌：
Article 8 Any ship shall be marked with the followings:
一船名。
1.
Name of the ship;
二船籍港名。
2.
Name of the port of registry;
六法令所規定之其他標誌。

Other marks specified in laws and regulations.
