第2條 本法適用於含人文社會科學之科學技術。
Article 2 This Act shall be applicable to the science and technology in the field of humanities and social sciences.
政府於推動科學技術時，應注意人文社會科學與其他科學技術之均衡發展。
When promoting science and technology, the government shall pay special attention to a balanced development between the field of humanities and social sciences, and other fields of science and technology.
第3條 政府應於國家財政能力之範圍內，持續充實科學技術發展計畫所需經費。
Article 3 The government shall, within the nation's financial capacity, continue to provide for the expenditures necessary for scientific and technological development projects.
政府應致力推動全國研究發展經費之穩定成長，使其占國內生產毛額至適當之比例。
The government shall devote efforts to support the stable growth of domestic expenditures in research and development, so as to raise such expenditures to an appropriate percentage of the gross domestic product (GDP).
第4條 政府應採取必要措施，以持續充實基礎研究。
Article 4 The government shall take necessary measures to maintain the growth of basic research.
第5條 政府應協助公立學校、公立研究機關(構)、公營事業、法人或團體，充實人才、設備及技術，以促進科學技術之研究發展。
Article 5 The government shall assist research organizations and the research and development units of public and private businesses to build up human resources, equipment, and technology, so as to advance scientific and technological research and development.
為推廣政府出資之應用性科學技術研究發展成果，政府應監督或協助前項執行研究發展之單位，將研究發展成果轉化為實際之生產或利用。
For the purpose of promoting the research and development results of applied scientific and technological projects funded by the government, the government shall supervise or assist the research organizations and units mentioned in the preceding Paragraph to industrialize or commercialize their research results.
第6條 政府補助、委託或出資之科學技術研究發展，應依評選或審查之方式決定對象，評選或審查應附理由。
Article 6 Projects in scientific and technological research and development to be subsidized, commissioned, or funded by the government shall be selected through a process of evaluation or review, and the results thereof shall be justified with reasons.
其所獲得之智慧財產權及成果，得將全部或一部歸屬於執行研究發展之單位所有或授權使用，不受國有財產法之限制。
The intellectual property rights and results derived from such a project may be conferred, in whole or in part, to the research organization or business for ownership or licensing for use, and are not subject to the National Property Act.
前項智慧財產權及成果之歸屬及運用，應依公平及效益原則，參酌資本與勞務之比例及貢獻，科學技術研究發展成果之性質、運用潛力、社會公益、國家安全及對市場之影響，就其要件、期限、範圍、比例、登記、管理、收益分配、資助機關介入授權第三人實施或收歸國有及相關程序等事項之辦法，由行政院統籌規劃訂定；各主管機關並得訂定相關法規命令施行之。
The ownership and utilization of the intellectual property rights and results referred to in the preceding Paragraph shall be determined based on the principles of fairness and effectiveness by assessing the proportion and contribution of capital and labor, the nature of the research and development result, potential uses, societal benefits, national security, and impacts on the market.
Matters pertaining to the prerequisites, effective period, scope, proportion, registration, administration, allocation of profit, intervention by the funding agency into the matter of a third party licensed to implement the research and development result, the funding agency declaring the research and development result to be national property, and other relevant procedures shall be arranged by the Executive Yuan and governed by the relevant laws and regulations prescribed separately by various competent authorities.
公立學校、公立研究機關(構)、法人或團體接受第一項政府補助辦理採購，除我國締結之條約或協定另有規定者外，不適用政府採購法之規定。
For a juristic person or entity receiving the government subsidies mentioned in Paragraph 1 of this Article to perform procurement, if the subsidy amount is not less than half of the procurement value and also reaches the threshold for publication, this procurement shall not be subject to the regulation of the Government Procurement Act, but shall be supervised by the subsidizing agency.
但應受補助機關之監督；其監督管理辦法，由相關中央主管機關定之。
Regulations governing the matters of such supervision shall be prescribed by the appropriate competent authority at the central government level.
第7條 為推動科學技術發展，政府應考量總體科學技術政策與個別科學技術計畫對環境生態之影響。
Article 7 For the purpose of promoting scientific and technological development, the government shall consider the impact of overall scientific and technological policies and of individual scientific and technological projects on the environmental ecology.
政府推動科學技術發展計畫，必要時應提供適當經費，研究該科學技術之政策或計畫對社會倫理之影響與法律因應等相關問題。
When conducting a project in scientific and technological development, the government shall provide appropriate levels of expenditures when necessary to study the matters relevant to the impact of such scientific and technological policy or project on social ethics and legal issues.
第8條 科學技術研究機構與人員，於推動或進行科學技術研究時，應善盡對環境生態、生命尊嚴及人性倫理之維護義務。
Article 8 When implementing or conducting scientific and technological research, the scientific and technological research organizations and personnel shall properly fulfill their obligations to safeguard the environmental ecology, the respect for life, and humanitarian ethics.
第9條 政府應每二年提出科學技術發展之遠景、策略及現況說明。
Article 9 The government shall present a written statement once every two years describing the visions, strategies, and current status of scientific and technological development.
第10條 政府應考量國家發展方向、社會需求情形及區域均衡發展，每四年訂定國家科學技術發展計畫，作為擬訂科學技術政策與推動科學技術研究發展之依據。
Article 10 The government shall formulate a National Science and Technology Development Plan once every four years reflecting the nation's developmental trends, the needs of society, and the goal of balanced regional development.
This Plan shall serve as a basis for formulating scientific and technological policies and promoting scientific and technological research and development.
國家科學技術發展計畫之訂定，應參酌中央研究院、科學技術研究部門、產業部門及相關社會團體之意見，並經全國科學技術會議討論後，由行政院核定。
The content of the National Science and Technology Development Plan shall take into consideration the opinions of the Academia Sinica, the scientific and technological research sector, the industrial sector, and relevant social organizations, and shall be reviewed and approved by the Executive Yuan following discussions at the National Science and Technology Conference.
前項之全國科學技術會議，每四年由行政院召開之。
The National Science and Technology Conference mentioned in the preceding Paragraph shall be convened once every four years by the Executive Yuan.
第11條 國家科學技術發展計畫，應包含下列事項︰
Article 11 The National Science and Technology Plan shall include the following matters:

第12條 為增進科學技術研究發展能力、鼓勵傑出科學技術研究發展人才、充實科學技術研究設施及資助研究發展成果之運用，並利掌握時效及發揮最大效用，行政院應設置國家科學技術發展基金，編製附屬單位預算。
Article 12 For the purposes of improving capabilities in scientific and technological research and development, encouraging outstanding personnel in scientific and technological research and development, enhancing scientific and technological research facilities, subsidizing the use of research and development results, and to facilitate timeliness and maximize effectiveness, the Executive Yuan shall establish the National Science and Technology Development Fund and formulate budgets for the subsidiary units.
國家科學技術發展基金之運用，應配合國家科學技術之發展與研究人員之需求，經公開程序審查，並應建立績效評估制度。
The National Science and Technology Development Fund shall be used in accordance with the needs of national scientific and technological development and research personnel, shall be evaluated through public procedures, and shall establish a system for assessing effectiveness.
國家科學技術發展基金之收支、保管及運用辦法，由行政院定之。
The regulations governing the revenues, expenditures, safekeeping, and use of the National Science and Technology Development Fund shall be prescribed by the Executive Yuan.
