(b) 管理局根據本條例發出的指示；或
(b) a direction issued by the Authority under this Ordinance; or
(c) 牌照的任何條款或條件。
(c) any of the terms or conditions of the licence.

" (2) The financial penalties imposed under this section in respect of satellite television services shall not exceed $50000 for the first occasion on which a penalty is imposed, $100000 for the second occasion on which a penalty is imposed for whatever reason and $250000 for any subsequent occasion on which a penalty is imposed for whatever reason."
(3) 根據本條就星聲音服務而施加的罰款，如屬第一次施加，則不 得超逾$20000，如屬第二次不論因任何理由而施加，則不得超逾$50000， 如屬其後任何一次不論因任何理由而施加，則不得超逾$100000。
" (3) The financial penalties imposed under this section in respect of satellite sound services shall not exceed $20000 for the first occasion on which a penalty is imposed, $50000 for the second occasion on which a penalty is imposed for whatever reason and $100000 for any subsequent occasion on which a penalty is imposed for whatever reason."
(4) 除非管理局信納牌照持有人已獲給予合理機會遵從守則、指示、 條款或條件，否則不得根據本條施加罰款。
" (4) No penalty shall be imposed under this section except where the Authority is satisfied that the holder of the licence has been afforded reasonable opportunity of complying with the Code, direction, term or condition."
(a) 業務守則的條文或管理局發出的指示；或
(a) a provision of a Code of Practice or direction issued by the Authority; or
(b) 管理局在行使根據牌照或本條例賦予管理局的酌情權時所作出的 決定，
" (b) a decision of the Authority in the exercise of a discretion vested in it under the licence or this Ordinance,"
則可在守則發出日期後30天內，或在管理局向其通知管理局的指示或 決定的日期後30天內(視屬何情況而定)，以呈請方式向總督會同行政局提 出上訴。
" may within 30 days after the date of issue of the Code or notification to him of the direction or decision of the Authority, as the case may be, appeal by way of petition to the Governor in Council."
(2) 根據本條提出的上訴，並不使守則的條文或管理局的指示或決定 在上訴裁定之前暫停執行。
" (2) An appeal under this section does not suspend the provision of the Code, direction or decision before the determination of the appeal."
(3) 總督會同行政局在裁定一項上訴時，可收取包括管理局在內的任 何來源的意見及資料，而無須向上訴人披露有關的意見及資料；上訴人除 其呈請書外，無權作出任何其他陳述。
(3) In determining an appeal the Governor in Council may receive advice and information from any source including the Authority without disclosing the advice and information to the appellant who is not entitled to make any representations other than his petition.
(4) 總督會同行政局在裁定一項上訴時，可修訂守則，或確認、更改 或推翻管理局的指示或決定。
" (4) The Governor in Council may determine an appeal by amending the Code or by confirming, varying or reversing the direction or decision of the Authority."
(1) 管理局須委任一個由不少於5名管理局委員組成的投訴委員會。
(1) The Authority shall appoint a Complaints Committee consisting of not less than 5 members of the Authority.
(2) 委員會可按其認為適合者而委任其他人為委員會的委員。
(2) The Committee may appoint such other persons to be members of the Committee as it deems fit.
(3) 根據第(2)款委任的委員會委員─
(3) A member of the Committee appointed under subsection (2)-
(b) 對委員會席上審議的事宜沒有投票權。
(b) shall not have a vote on matters before the Committee.
(4) 委員會須在根據第(1)款委任的委員中指定一人為委員會主席。
(4) The Committee shall appoint one of its members appointed under subsection (1) to be its chairman.
(5) 委員會委員─
(5) A member of the Committee-
(a) 的任期除(b)段及第(6)款另有規定外由管理局決定，如屬根據第 (2)款委任的委員，則由委員會決定；及
" (a) shall, subject to paragraph (b) and to subsection (6), hold office for such period as the Authority or, in the case of a member appointed under subsection (2), the Committee, may determine; and"
(b) 可隨時藉致予管理局的書面通知而辭去在委員會的職務，如屬根 據第(2)款委任的委員，則可藉致予委員會主席的書面通知而辭去在委員 會的職務。
" (b) may resign from the Committee at any time by notice in writing addressed to the Authority or, in the case of a member appointed under subsection (2), to the chairman of the Committee."
(6) 根據第(1)款委任的委員會委員，須在停任管理局委員時停止任職 。
(6) A member of the Committee appointed under subsection (1) shall cease to hold office if he ceases to be a member of the Authority.
(7) 在符合本條及第11條的規定下，委員會須決定本身的程序。
" (7) Subject to this section and to section 11, the Committee shall determine its own procedures."
(1) 除第(2)及(3)款另有規定外，凡有人向管理局投訴持牌人或任何 其他人違反─
" (1) Subject to subsections (2) and (3), where a person makes a complaint to the Authority that a licensee or any other person has contravened-"
(a) 本條例、《電視條例》(第52章)或《電訊條例》(第106章)第IIIA 部； (由1989年第52號第4條代替)
" (a) this Ordinance, the Television Ordinance (Cap 52) or Part IIIA of the Telecommunication Ordinance (Cap 106); (Replaced 52 of 1989 s.4)"
(b) 牌照的條款或條件；或
(b) the terms or conditions of a licence; or
