186. 法律应当规定,有形资产上的保留所有权权利或融资租赁担保权不具有效力,除非售货协议或租赁协议以书面形式订立或具有书面凭证,结合当事人之间的行为过程可以表明出卖人或出租人保留所有权的意图。
The law should provide that a retention-of-title right or a financial lease right in a tangible asset is not effective unless the sale or lease agreement is concluded in or evidenced by a writing that in conjunction with the course of conduct between the parties indicates the seller's or the lessor's intent to retain ownership.
