(1) 如在根據本條例第15或17條進行研訊的過程中，法律顧問就任何法 律問題或就證據、程序或其他事項向委員會提供意見，他須在研訊程序的 各方或各方的代表在場時提出，或如該意見是在委員會已就其裁斷開始商 議之後提出的，則須以口頭或書面方式將法律顧問所提供的意見通知上述 各方或各人。
(1) When the legal adviser advises the Board on any question of law or as to evidence, procedure or any other matter in the course of any inquiry held by the Board under section 15 or 17 of the Ordinance he shall do so in the presence of every party to the proceedings or the representative of any such party or,if the advice is tendered after the Board has commenced to deliberate as to its findings, every such party or person as aforesaid shall be informed either verbally or in writing of the advice which the legal adviser has tendered.
(2) 在任何情況下，凡委員會不接納法律顧問就上述任何問題所提供的 意見，上述各方或各人須獲得據此而作出的通知。
(2) In any case where the Board does not accept the advice given by the legal adviser on any such question aforesaid, every such party or person shall be informed accordingly.
在不損害第39條所載條文的原則下，法律顧問除非在會議前接獲秘書通 知，得悉相當可能特別需要他在該會議出席，否則無須出席委員會的會議 。
Without prejudice to anything contained in regulation 39, the legal adviser shall not be required to attend meetings of the Board unless notified by the secretary in advance of any meeting that his presence is likely to be specifically required thereat.

本條例旨在就醫院、護養院及留產院的註冊及視察，以及就相關事宜訂 定條文。
To provide for the registration and inspection of hospitals, nursing homes and maternity homes and for purposes connected therewith.
本條例可引稱為《醫院、護養院及留產院註冊條例》。
This Ordinance may be cited as the Hospitals, Nursing Homes and Maternity Homes Registration Ordinance.
(1) 在本條例中，除文意另有所指外─
(1) In this Ordinance, unless the context otherwise requires-
“署長”(Director) 指生署署長； (由1990年第68號第24條代替)
“Director” (署長) means the Director of Health; (Replaced 68 of 1990 s. 24)
“醫院”(hospital) 指任何照顧病人、傷者或衰弱者或需要醫療的人 的機構，包括護養院，但不包括任何由官方經辦的醫院或《醫院管理局條 例》(第113章)所指的公營醫院。 (由1990年第68號第24條修訂)
“hospital” (醫院) means any establishment for the care of the sick, injured or infirm or those who require medical treatment, including a nursing home, but does not include any hospital maintained by the Crown or a public hospital within the meaning of the Hospital Authority Ordinance (Cap 113); (Amended 68 of 1990 s. 24)
“留產院”(maternity home) 指用作或擬用作收容懷孕婦女或剛分娩 婦女的任何處所，但不包括任何由官方經辦的留產院、或作為《醫院管理 局條例》(第113章)所指的公營醫院一部分而經營的任何留產院、或根據 該條例設立的醫院管理局所管理或控制的任何留產院； (由1992年第84 號第2條修訂)
“maternity home” (留產院) means any premises used or intended to be used for the reception of pregnant women or of women immediately after childbirth, but does not include any maternity home maintained by the Crown or any maternity home run as part of a public hospital within the meaning of the Hospital Authority Ordinance (Cap 113) or any maternity home managed or controlled by the Hospital Authority established under that Ordinance; (Amended 84 of 1992 s. 2)
“見習助產士”(pupil midwife) 指姓名已根據《助產士(註冊及紀律 處分程序)規例》(第162章，附屬法例)第8條由助產士管理局註冊的女子 ；
“pupil midwife” (見習助產士) means a woman whose name is registered with the Midwives Board under regulation 8 of the Midwives (Registration and Disciplinary Procedure) Regulations (Cap 162 sub. leg.);
“註冊助產士”(registered midwife) 指根據或按照《助產士註冊條 例》(第162章)第8條註冊或當作為已根據或按照該條註冊為助產士的女子 ；
“registered midwife” (註冊助產士) means a woman who is registered or deemed to have been registered as a midwife under or in accordance with section 8 of the Midwives Registration Ordinance (Cap 162);
“註冊護士”(registered nurse) 指姓名列於按照《護士註冊條例》( 第164章)第5條所備存的註冊護士名冊第I部分內的護士；
“registered nurse” (註冊護士) means a nurse whose name appears in Part I of the register of nurses maintained in accordance with section 5 of the Nurses Registration Ordinance (Cap 164).
(2) 就純粹用作或擬純粹用作收容及護理某類病人的任何處所而言，( 而該類病人所必需的護理服務，可恰當及充分地由姓名載於按照《護士註 冊條例》(第164章)第5條所備存的註冊護士名冊除第Ⅰ部分外的其他某部 分的某類護士所提供者)，在“註冊護士”(registered nurse) 定義內對 註冊護士名冊第I部分的提述，須解釋為包括對該名冊該其他部分的提述 。
(2) In relation to any premises used or intended to be used solely for the reception of, and the provision of nursing for, a class of patients in whose case the requisite nursing can be suitably and adequately provided by nurses of a class whose names are contained in some part of the register of nurses maintained in accordance with section 5 of the Nurses Registration Ordinance (Cap 164) other than Part I of that register, references in the definition “registered nurse” (註 冊護士) to Part I of the register of nurses shall be construed as including references to that other part of the register.
(1) 任何人如未就某醫院或留產院妥為註冊而營辦該院，即屬犯罪，一 經循簡易程序定罪，可處罰款$1000，第二次或其後定罪可處罰款$1000及 監禁3個月。 (由1950年第22號附表修訂；由1966年第17號第3條修訂)
(1) If any person carries on a hospital or a maternity home without being duly registered in respect thereof, he shall be guilty of an offence and shall be liable on summary conviction to a fine of $1000, or in the case of a second or subsequent offence, to a fine of $1000 and imprisonment for 3 months. (2) 註冊的申請須使用署長訂明的表格以書面向署長提出。
(2) Application for registration shall be made to the Director in writing in a form prescribed by him.

申請人凡有 意將處所註冊為醫院並註冊為留產院，須使用各別的表格。
(2) Application for registration shall be made to the Director in writing in a form prescribed by him.
