(1) 所有通向在損毀分析中假定為完整的且位於最終損毀水線以下的 艙室的外部開口,須是水密的。
" (1) All external openings leading to compartments assumed intact in the damage analysis, which are below the final damage waterline, shall be watertight."
(2) 按照第(1)款規定為水密的外部開口須有足夠的強度,而除貨艙口 蓋外,並須在駕駛台裝有顯示器。
" (2) External openings required to be watertight in accordance with subsection (1) shall be of sufficient strength and, except for cargo hatch covers, shall be fitted with indicators on the bridge."
(4) 儘管第(3)款另有規定,如為了船舶的操作需要並且不損害船舶的 安全,核證當局可授權船長酌情決定開啟某些門。
" (4) Notwithstanding the requirements of subsection (3), the Certifying Authority may authorize that particular doors may be opened at the discretion of the master, if necessary for the operation of the ship and provided that the safety of the ship is not impaired."
(6) 凡任何船舶沒有符合第(1)、(2)、(3)或(5)款的任何規定,該船 舶的船東及船長各自屬犯罪,可處罰款$20000及監禁2年。
" (6) Where a ship does not conform to any requirement in subsection (1), (2), (3) or (5), the owner and master of the ship each commits an offence and is liable to a fine of $20000 and to imprisonment for 2 years."
驗船師為發出貨船構造安全證明書而進行船舶檢驗時,須在發出證明 書前,顧及該船舶擬提供的服務以及該證明書的有效期限,確定可否信納 該船舶已符合本規例的規定至令人滿意的程度。
" A surveyor carrying out a survey of a ship for the purpose of issuing a cargo ship safety construction certificate shall, before issuing such certificate, satisfy himself that the requirements in this Regulation have been complied with to an extent which is satisfactory having regard to the service for which the ship is intended and the period for which the certificate is to be issued."
(1) 每艘船舶須保持在符合本規例的狀況,而在沒有核證當局的批准 下,船舶的結構不得以任何方式更改。
(1) Every ship shall be maintained in such condition so as to conform to this Regulation and the structure of the ship shall not be altered in any manner without the approval of the Certifying Authority.
(2) 凡沒有按第(1)款的規定保持任何船舶的狀況,或違反該款的規定 而在沒有核證當局的批准下更改船舶的結構,該船舶的船東及船長各自屬 犯罪,可處罰款$20000及監禁2年。
" (2) Where a ship is not maintained as required under subsection (1) or an alteration is made to the structure of the ship without the approval of the Certifying Authority in contravention of that subsection, the owner and master of the ship each commits an offence and is liable to a fine of $20000 and to imprisonment for 2 years."
凡本規例規定須符合某項規定,處長如藉試驗或其他方法信納任何替 代布置就確保船舶安全而言,至少與符合該項規定同樣有效,則他可就某 艘船舶或某類船舶接受或准許該替代布置,作為已符合該項規定。
" Where this Regulation requires the compliance with a particular requirement, the Director may, in relation to a particular ship or a class of ships, accept or permit an alternative arrangement as compliance with such requirement, where he is satisfied by trial or otherwise, that such arrangement is at least as effective for the purpose of ensuring the safety of the ship as compliance with such requirement would have been."
處長可─
The Director may-
(a) 藉憲報刊登的公告,修訂附表;及
(a) by notice published in the Gazette amend the Schedule; and
“現有船舶”(existing ship) 指任何在1980年5月25日前安放龍骨或 處於相若建造階段的船舶。
" ""existing ship"" (現有船舶) means a ship the keel of which was laid or which was at a similar stage of construction before 25 May 1980;"
(a) 在以下界線內的香港鄰近水域─
(a) the waters within the vicinity of Hong Kong within the following boundaries-
(i) 東面界線:東經114°30’;
" (i) to the east, meridian 114o 30' east;"
(ii) 南面界線:北緯22°09’;及
" (ii) to the south, parallel 22o 09' north; and"
(iii) 西面界線:東經113°31’;及
" (iii) to the west, meridian 113o 31' east; and"
(b) 可從(a)段所界定的範圍經內陸水道到達的中國大陸廣東省及廣西 壯族自治區境內的所有內陸水道;
(b) all inland waterways in the Guangdong Province and Guangxi Autonomous Region on the mainland of China to which access can be obtained by inland waterways from the area defined in paragraph (a).
(b) 在香港水域內的其他船舶。
(b) other ships while they are within the waters of Hong Kong.
(a) 不適用於持有有效的下述證明書的任何船舶─
(a) a ship in respect of which there is in force-
(i) 根據本條例第14條發出的乘客定額證明書,述明該船舶適合在內 河航限內往來;及
(i) a passenger certificate issued under section 14 of the Ordinance stating that the ship is fit to ply within river trade limits; and
(ii) 任何船舶而其船旗國並非《1974年國際海上人命安全公約》*的 締約國者,
" (ii) flying the flag of a State which is not a party to the International Convention for the Safety of Life at Sea 1974,"
而倘非因惡劣天氣或因不是船長、船東或船舶承租人(如有的話)所能 阻止的其他情況,該船舶即不會在該水域內的。
" by reason of its being within the waters of Hong Kong if it would not have been in such waters but for stress of weather or any other circumstances which could not have been prevented by the master, the owner or the charterer (if any)."
為施行本規例,本規例所適用的船舶,其分類編排依照為施行《商船( 安全)(救生裝置)(1986年7月1日之前建造的船舶)規例》(第369章,附屬 法例)而作出的船舶分類編排,而本規例中對任何一類船舶的提述,均須 據此解釋。
For the purpose of this Regulation the ships to which this Regulation applies shall be arranged in the same classes in which ships are arranged for the purposes of the Merchant Shipping (Safety) (Life-Saving Appliances) (Ships Built Before 1 July 1986) Regulations (Cap 369 sub. leg.) and any reference in this Regulation to a ship of any class shall be construed accordingly.
(b) 第X類,而在正常操作情況下,由水面至進入船舶點的距離超過 2.5米者;或
" (b) Class X where the distance in normal operating conditions, from the water to the point of access to the ship, exceeds 2.5 metres; or"
(c) 第IX、IX(A)、IX(A)(T)或XI類,而行走任何相當可能僱用領港員 的航程者,
" (c) Classes IX, IX(A), IX(A)(T) or XI when engaged on a voyage during the course of which a pilot is likely to be employed,"
