(1) 在不損害《道路交通條例》(第374章)第63條的原則下，凡有汽車 的駕駛人被懷疑在隧道區內犯了違反本條例的罪行，則任何人(包括車輛 的登記車主，以及被懷疑在該指稱的罪行發生時是車輛駕駛人的人)須應 在指稱的罪行發生日期後3個月內所作出的要求，並按照本條所訂明的方 式向隧道人員提供在該指稱的罪行發生時駕駛該車輛的人的姓名、地址及 駕駛執照號碼，以及他與該駕駛人的關係(如有的話)。
" (1) Without prejudice to section 63 of the Road Traffic Ordinance (Cap 374), where the driver of a motor vehicle is suspected of having committed an offence against this Ordinance in the tunnel area, any person (including both the registered owner of the vehicle and the person suspected of being the driver of the vehicle at the time of the alleged offence) shall, on demand made within 3 months after the date of the alleged offence, give to a tunnel officer in the manner prescribed in this section the name, address and driving licence number of the person driving the vehicle at the time of the alleged offence and his relationship (if any) to the driver."
(2) 根據第(1)款所作出的要求，可以口頭作出，或以通知書面交送達 被要求的人，或郵遞送達該人。
(2) A demand under subsection (1) may be made orally or by means of a notice served personally or by post on the person on whom it is made.
(a) 在該指稱的罪行發生時是該車輛的駕駛人，則他須─
(a) if he was the driver of the vehicle at the time of the alleged offence-
(ii) 在該項要求作出的日期後21天內，向指明的隧道人員提供其駕駛 執照號碼；及
(ii) give the number of his driving licence to a specified tunnel officer within 21 days after the date of the demand; and
(b) 在該指稱的罪行發生時並非該車輛的駕駛人，則他須在該項要求 作出的日期後21天內，以口頭或書面向指明的隧道人員提供第(1)款所規 定的資料。
" (b) if he was not the driver of the vehicle at the time of the alleged offence, give the information required under subsection (1) to a specified tunnel officer either orally or in writing within 21 days after the date of the demand."
(4) 根據第(2)款發出的通知書，須要求被通知的人─
(4) A notice under subsection (2) shall require the person to whom it is addressed-
(a) 在該通知書的日期後21天內，以通知書所指明的格式，向其內所 指明的隧道人員提交一份陳述書，說明在該指稱的罪行發生時駕駛該車輛 的人的姓名、地址及駕駛執照號碼，以及他與該駕駛人的關係(如有的話) ；及
" (a) to furnish, within 21 days after the date of the notice, to a tunnel officer specified therein, a written statement, in such form as may be specified in the notice, giving the name, address and driving licence number of the person driving the vehicle at the time of the alleged offence and his relationship (if any) to the driver; and"
(b) 在該陳述書上簽署。
(b) to sign the said statement.
(6) 在為第(5)款所訂罪行而進行的法律程序中，如能顯示被控人不知 道，而經合理努力後亦不能確定在該指稱的罪行發生時駕駛該車輛的人的 姓名、地址及駕駛執照號碼，即為免責辯護。
" (6) In proceedings for an offence under subsection (5), it shall be a defence to show that the accused person did not know, and could not with reasonable diligence have ascertained, the name or address or driving licence number of the person driving the vehicle at the time of the alleged offence."
在為本條例所訂罪行而進行的任何簡易程序中，如向法庭出示的陳述 書─
" If, in any summary proceedings for an offence under this Ordinance, there is produced to the court a statement which-"
(a) 看來是由被控人簽署的；
(a) purports to have been signed by the accused person;
(c) 說明被控人在該罪行發生時是有關車輛的駕駛人，
" (c) states that the accused person was the driver of the vehicle at the time of the offence,"
則法庭須接納該陳述書為表面證據，證明被控人在該罪行發生時是該 車輛的駕駛人。
the court shall admit the statement as prima facie evidence that the accused person was the driver of the vehicle at the time of the offence.
(1) 在任何就違反本條例的罪行而提出的檢控中，經運輸署署長核證 的圖則副本，即為隧道區的確證。
" (1) In any prosecution for an offence against this Ordinance, a copy of the plan, certified by the Commissioner to be a copy of such plan, shall be conclusive proof of the tunnel area."
(2) 除非相反證明成立，否則任何看來是經運輸署署長核證的圖則副 本，須當作已由其核證。
" (2) Any such copy purporting to be certified by the Commissioner shall be deemed, until the contrary is proved, to have been certified by him."
“駕駛人”(driver)，就任何汽車而言，指任何掌管或協助控制該車 輛的人；
" ""driver"" (駕駛人) , in relation to any motor vehicle, means any person who is in charge of or assisting in the control of such vehicle;"
“駕駛執照”(driving licence) 指按根據《道路交通條例》(第374 章)第8條訂立的規例發出的執照；
" ""driving licence"" (駕駛執照) means a licence issued in accordance with regulations made under section 8 of the Road Traffic Ordinance (Cap 374);"
“車主”(owner) 包括根據《道路交通條例》(第374章)以其名義登記 車輛的人，以及保管與使用該車輛的人，而根據屬租用協議或租購協議租 售的車輛而言，則指根據該協議管有該車輛的人；
" ""owner"" (車主) includes the person in whose name a vehicle is registered under the Road Traffic Ordinance (Cap 374) and the person by whom the vehicle is kept and used and, in relation to a vehicle which is the subject of a hiring agreement or hire purchase agreement, means the person in possession of the vehicle under that agreement;"
“隧道人員”(tunnel officer) 指由公司就隧道區內的交通管制、限 制及安全而僱用的人。
" ""tunnel officer"" (隧道人員) means any person employed by the Company in connection with the control, restriction and safety of traffic in the tunnel area."
(2) 由第41條所賦予隧道人員的權力，只可在隧道區內行使，但根據 該條第(2)款藉送達通知書作出要求的權力則除外。
" (2) The powers conferred on a tunnel officer by section 41, other than the power to make a demand by serving a notice under subsection (2) of that section, may be exercised only within the tunnel area."
失責行為及專營權的有效期屆滿
DEFAULT AND EXPIRATION OF THE FRANCHISE
為施行本部，如有下述情況，公司即當作有失責行為─
" For the purposes of this Part, the Company shall be deemed to be in default if-"
(a) 公司沒有或極有可能不會在第14條所允許的期限或所允許的延長 期限內完成建造工程；
(a) it has failed or there is a substantial likelihood of its failing to complete the construction works within the period or extended period allowed by section 14;
(b) 公司在極大程度上沒有根據工程項目協議履行其義務；
(b) there has been a substantial failure by it to discharge its obligations under the project agreement;
